1. Acceptance of Terms

By accessing or using PrimeHeadshots ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time; continued use constitutes acceptance of any changes.

2. Eligibility

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement and that the information you provide is accurate and complete.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use. We reserve the right to suspend or terminate accounts that violate these terms.

4. Service Description

PrimeHeadshots provides AI-generated professional headshots using the photos you upload. Results may vary based on input photo quality, lighting, angles, and resolution. We do not guarantee specific outcomes, and generated images are provided on an "as-is" basis.

5. User Content & Ownership

You retain full ownership of all photos you upload and headshots we generate for you. By uploading content, you grant us a limited, non-exclusive licence to process, store, and generate images solely for the purpose of delivering the Service to you. We do not claim ownership of your content and we do not use it for AI model training.

6. Prohibited Content & Conduct

You may not upload photos that: (a) depict individuals other than yourself without their explicit consent; (b) contain nudity, sexually explicit, or otherwise obscene material; (c) promote violence, hate speech, harassment, or illegal activity; or (d) infringe on any third-party intellectual property rights. We reserve the right to refuse service and terminate accounts for prohibited content at our sole discretion.

7. Payment & Pricing

All purchases are processed via Dodo Payments. Prices are displayed in USD and are subject to change with notice. You agree to pay all charges associated with your selected plan. Credits purchased are non-transferable and expire 12 months from the date of purchase if unused.

8. Refunds

Refund eligibility is governed by our Refund Policy. In summary: unused credits qualify for a full refund, and partially used credits may qualify for a 50% refund if you're not satisfied. All refund requests must be submitted within 24 hours of purchase. See our Refund Policy for complete details.

9. Intellectual Property

The PrimeHeadshots brand, website, logo, UI design, software code, and all non-user-generated content are owned by PrimeHeadshots and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

10. Third-Party Services

The Service may integrate with third-party platforms (e.g., Google Cloud, Dodo Payments, SuperTokens). We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of such services is subject to their respective terms.

11. Limitation of Liability

To the fullest extent permitted by law, PrimeHeadshots and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless PrimeHeadshots, its officers, directors, and employees from any claims, losses, or damages arising from your violation of these terms, your misuse of the Service, or your infringement of third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, suspected fraud, or any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time via your account settings.

14. Dispute Resolution

Any disputes arising from these terms shall first be resolved through informal negotiation. If unresolved, disputes shall be settled through binding arbitration in accordance with applicable laws. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
